Hear from Jamil

 

On Thursday March 10, 2011 Jamil Joyner was sentenced by Judge Terry Q. Alarcon to 35 years without eligibility for Parole. Prior to the announcement of the sentencing, Jamil stood in front of Judge Alarcon and the court and delivered the following statement concerning his entire experience with the Orleans Parish Judicial System:

 

Let me state for the record that I am a Man, living and walking upon the land and speaking as only a Man can. I have voluntarily submitted to the judicial system and before the court from August 30, 2005 until this date with the hope that I would receive fair treatment and an impartial trial so that due process is achieved and justice would truly be served; being innocent until proven guilty. Instead as a person who prior to this experience had no criminal record, from the beginning I have been treated like a hardened criminal, hunted down like a fugitive, I’ve been beaten [beyond recognition], lied on, and this is what I witnessed and experienced from the court proceeding: 

 

  • This entire proceeding, and related officers of the law and officers of the court, from my initial arrest up to and including this sentencing, has failed to follow legal due process.

  • This proceeding has failed to provide a fair trial where I am presumed innocent until proven guilty;

  • This proceeding has failed to set the matter for arraignment as the district attorney is instructed to do within the specified timeframe outlined by law;

  • This proceeding has denied me the benefit of a contradictory hearing and the right to bail;

  • This proceeding has failed to provide the right to a speedy, public and impartial trial; 

  • This proceeding failed to produce a valid motive; 

  • This proceeding has failed to produce any tangible physical evidence that points to or proves my guilt;

  • This proceeding has failed to prove the authenticity of the police report for this case, since it was clearly edited, amended, and tampered;

  • This proceeding and court allowed the prosecution to present a credible witness and purposefully work to unethically impeach that [their own] witness by allowing the use of completely hearsay testimony;

  • This proceeding has viciously, unjustly and unlawfully attacked and defamed my character, mislabeling and mischaracterizing me as a hoodlum or thug based on a presumption of guilt rather than facts of how I lived my life every day. Prior to this proceeding I lived my life as a productive citizen, a local businessman employing citizens of New Orleans and paying my taxes. I lived in accordance with the law and I had no personal vendettas against police, as is evident in the fact that prior to these proceedings I had no criminal record;

  • This proceeding and the court demonstrated blatant bias in disallowing exposure of conflicting statements from Officer Kevin Thomas, to be brought out in court where he initially stated in the police report that he could not identify his shooter because he didn’t remember being shot, yet allowing him to get on the witness stand and identify me as the shooter

  • The court also demonstrated blatant bias in ruling on the Motion for Retrial, in cases where ‘credible’ prosecution witness testimonies conflicted. This court actively sifted through and chose to pull from the specific testimonies that weighed negatively on me, no matter how ridiculous the accusation, versus those that didn’t necessarily weigh negatively on me, as a basis to deny the Motion for Retrial (click here to view the Ruling on Motion for Retrial). Including but not limited to choosing the testimony of prosecution witness Officer Gregory Joeger over the testimony of prosecution witness Officer Darren Gross (Officer Gros testified to only hearing Jamil say 'I'm a soldier' not 'I killed one cop and I'll kill another cause I'm a soldier'); choosing Officer Kevin Thomas’ testimony over Officer John Mitchell’s testimony; choosing Officer Robert Italiano’s hearsay testimony over Officer John Mitchell’s eyewitness testimony.

  • For the record I am not guilty of this crime for which I have been convicted. I never made the ridiculous statement Officer Gregory Joeger accused me of saying while surrounded by 15 – 20 armed officers with their weapons drawn, ‘I killed one cop and I’ll kill another cause I’m a soldier’. That is a blatant lie and he is guilty and should be tried for perjury for testifying to this lie on the witness stand. - We never received a single official command from Officer Kevin Thomas while at the Chevron station, we were never lined up and none of us were searched by him or Officer John Mitchell. At no time did I give Officer Kevin Thomas ‘static’ of any kind. I did not pull out a gun and I did not shoot him. That is a blatant lie and he is guilty and should also be tried for perjury for testifying to this lie on the witness stand.

 

As I conclude I would like to say that:

  • This proceeding has failed to produce an honorable ruling. 

  • This proceeding has failed to produce subject matter jurisdiction.

  • This proceeding – and this court – has now lost all jurisdiction by it's denial of due process. 

 

I have not violated any natural laws. I have not caused an injury to another living man. I have not committed a crime, and there is nothing on which to convict me, thus the conviction is null and void. I am canceling the conviction and all appearances on my part and now cancel any and all contracts, entered into by me, knowingly or unknowingly by any methods including but not limited to oral, written, nonverbal assertion or implied by me or on my behalf. And, any Bonds affiliated or associated with this case, whether they were issued in the form of a bid bond, or as an appearance bond, or as a performance bond which have been written as a result of this procedure – and any other bonds written in any way, shape or form whatsoever – I hereby now cancel, terminate, discharge, dismiss, deactivate, eradicate, nullify, revoke, and abolish – and I forbid the commercial use of My name and likeness for profit, as all Bonds created, whether on the record or not, are void ab initio as only I, a Man can cause.

 

I am innocent and I do not accept any offer to, nor do I give consent to, go to jail, go to prison, pay or discharge any fines, fees, court costs, nor taxes of any kind.

 

I do not accept nor consent to have My rights blocked or impeded in any way, shape, or form. I do not accept any offer, nor consent to have My body or possessions seized or confiscated or used by anyone or their agent for their own use, or for the benefit of another. I do not accept any offer nor do I consent to probation, parole, pre- or post-trial release, or any other form of supervision imposed for this matter or in association with this matter which may be attempted to be linked with or in causation with this matter, or placed twice in jeopardy for the same pretended crime.

 

I, this man, Jamil Abdul Willis Joyner, reserve all My natural God-given unalienable birth rights, waiving none, ever – as all is conditional upon My receipt of your written statement of claims and proof of claim to the contrary under your bond of office and penalties of perjury.

 

My public business here is completed, perfected, discharged, accomplished, dismissed, concluded, terminated and, as Jesus Christ stated: ‘It is finished’.

 

Jamil continues to maintain his innocense. Notice of Appeal has already been filed. So the fight to free Jamil Joyner shall continue until it is won.
